Terms of Service

By accessing https://creatorfps.com or using the CreatorFPS web application (the "Service"), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service.

CreatorFPS is a creator tool that helps you prepare video files for TikTok. It analyzes a file you select, reports its resolution, frame rate, bitrate and codec, optionally remuxes or re-encodes it in your browser to meet TikTok's ingest requirements, and — if you connect your account — publishes it to your own TikTok profile using TikTok's official Content Posting API.

CreatorFPS does not bypass, circumvent or interfere with TikTok's systems, rate limits, content moderation or delivery-side transcoding. Final playback quality is determined by TikTok, not by us.

• You must be at least 18 years old, or the age of majority where you live, and eligible to hold a TikTok account.
• You must provide accurate information when signing in and keep your credentials secure.
• You are responsible for all activity that occurs under your account.
• One person or organisation per account; do not share accounts.

• Connecting TikTok is optional and always initiated by you through TikTok's official OAuth screen.
• You grant CreatorFPS permission to upload and publish content to your account only for the posts you explicitly submit.
• You may disconnect at any time in the app, or revoke access in TikTok under Settings, then Security & permissions, then Manage app permissions.
• Your use of TikTok remains governed by TikTok's Terms of Service, Community Guidelines and Privacy Policy. Where those documents conflict with these terms in respect of your TikTok account, TikTok's documents prevail.

You retain all ownership of the videos, captions and other material you process ("Your Content"). You grant CreatorFPS a limited, revocable licence to process Your Content solely to perform the operations you request. We claim no other rights.

You represent and warrant that:

• You own Your Content or have all necessary rights, licences and permissions to publish it, including for any music, footage, trademarks or likenesses it contains.
• Your Content does not infringe intellectual property, privacy or publicity rights.
• Your Content complies with TikTok's Community Guidelines and all applicable laws.
• You will disclose branded content, paid partnerships and AI-generated material where required by TikTok or by law.

You must not use the Service to:

• Post spam, bulk automated content, engagement farming or coordinated inauthentic behaviour.
• Publish content that is illegal, hateful, harassing, sexually explicit, violent, deceptive, or harmful to minors.
• Impersonate any person or entity, or publish to an account you are not authorised to control.
• Scrape, reverse engineer, decompile, or attempt to extract source code from the Service.
• Interfere with, overload, or attempt to gain unauthorised access to the Service or to TikTok's systems.
• Resell, sublicense, or provide the Service as an unauthorised bulk posting or automation service.
• Circumvent any rate limit, quota, security measure or content policy of TikTok.

We may suspend or terminate access immediately for any violation, and may report serious abuse to TikTok or to the relevant authorities.

The Service is provided on an ongoing but not guaranteed basis. We may add, change, suspend or discontinue features at any time, and third-party APIs we depend on may change or become unavailable without notice. Processing very large or very high frame rate files depends on your device's memory and CPU and may fail on some hardware.

The Service is currently offered free of charge. If paid plans are introduced, pricing, billing terms and refund conditions will be presented before you purchase, and existing free functionality will not be removed retroactively without notice.

The Service, including its software, design, and branding, is owned by CreatorFPS and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. All third-party names and logos, including TikTok, are the property of their respective owners.

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that any upload will succeed, or that TikTok will deliver your video at the resolution or frame rate of your source file. TikTok applies its own transcoding and delivery rules to every upload.

To the maximum extent permitted by law, CreatorFPS is not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, content, goodwill, followers, reach or business opportunity, arising out of or related to your use of the Service. Our total aggregate liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim, or USD 50.

You agree to indemnify and hold harmless CreatorFPS and its operators from any claim, demand, loss or expense (including reasonable legal fees) arising from Your Content, your use of the Service, or your breach of these terms or of any third-party rights.

You may stop using the Service and delete your account at any time by emailing support@creatorfps.com. We may suspend or terminate your access if you breach these terms, if required by TikTok, or if we discontinue the Service. On termination, stored tokens are deleted and the licence granted to you ends. Sections 5, 9, 10, 11, 12 and 15 survive termination.

CreatorFPS is an independent third-party application built on TikTok's public developer platform. It is not affiliated with, endorsed by, sponsored by, or operated by TikTok Pte. Ltd., ByteDance Ltd., or any of their affiliates. "TikTok" is a trademark of its respective owner and is used here only to describe compatibility.

These terms are governed by the laws applicable at the place of our establishment, without regard to conflict-of-law rules. The parties will first attempt to resolve any dispute informally by contacting legal@creatorfps.com. Nothing in these terms limits consumer rights that cannot be waived under mandatory local law.

• These terms, together with the Privacy Policy, are the entire agreement between you and CreatorFPS.
• If any provision is held unenforceable, the remaining provisions stay in effect.
• Our failure to enforce a provision is not a waiver of it.
• You may not assign these terms; we may assign them in connection with a merger or acquisition.
• We may update these terms; material changes will be announced in the app and the effective date above updated.
